Terms & Conditions

ALL BIDDERS HEREBY CERTIFY THAT THEY HAVE READ AND FULLY UNDERSTAND THE TERMS AND CONDITIONS LISTED BELOW AND THEY AGREE TO BE BOUND THEREBY. EACH AUCTION MAY HAVE ADDITIONAL TERMS THAT ARE NOT LISTED HERE. IT IS THE BUYER'S RESPONSIBILITY TO UNDERSTAND ALL THE TERMS AND CONDITIONS PRIOR TO SUBMITTING ANY/ALL BIDS.

5% Buyer's Premium Fee, Not To Exceed $5,000.00 Per Individual Item. Buyer's Premium applies to all items and all bidders

Equipment Sold "As Is, Where Is"
All equipment /property is sold "AS IS, WHERE IS" with no warranty or guarantees, expressed or implied, by the seller or Del Peterson & Associates. ALL SALES ARE FINAL. Inspection of the property/equipment before bidding is strongly recommended. Verbal or written descriptions from the seller or Del Peterson & Associates are not guaranteed. Bidder's are responsible for inspection of the items and will not be issued a rebate or refund for any reason. It is the responsibility of the buyer to conduct any inspection and examination necessary to satisfy him/her of all material facts before placing any/all bids. Location of the equipment and the seller's contact information will be provided within the description of each item for sale.

Bidders accept all auction items/property "WITH ALL FAULTS", whether or not immediately apparent. Bidders are responsible for assessing actual current condition of the item(s)/property through personal inspection and careful review of the description, picture(s), and/or support documentation. Every bidder agrees that by placing a bid and the amount that he/she bids, has been based solely on his/her own independent inspection and evaluation of the auction item.

Internet Bidding
There is a 5% Buyer's Premium charged to all items purchased through Del Peterson & Associates On-Line Bidding Service. Lots may be combined as high bidder's choice, internet bidders will have 15 seconds to select choice after they're determined high bidder. If internet bidder does not make a choice within 15 seconds, the next available 1 lot will be default. Internet bidder agrees in advance to the previous statement to accept the next available lot. Del Peterson & Associates is providing pre-auction and live internet bidding as a service to bidders. Bidders acknowledge and understand that this service may or may not function properly the day of the auction. Under no circumstances shall Bidders have any kind of claim against Del Peterson & Associates or anyone else if the Internet service fails to work correctly before or during the live auction. Del Peterson & Associates will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Del Peterson & Associates reserves the right to withdraw or re-catalog items in this auction.

Bidders who bid from off site and are not present at the live auction understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. Del Peterson & Associates shall endeavor to describe in detail each item and any pertinent information about it. Del Peterson & Associates will not be responsible for any errors or omissions in the description of the item unless it is a material and intentional misrepresentation of the item itself.

Pictures
Del Peterson & Associates Employees and Sales Representatives are not professional photographers. Photos may or may not depict all the positives and negatives of an item. These photos and descriptions are to be used as a guideline only. All bidders are responsible for their own personal inspection of the item(s).

Odometer/Mileage/Hours
Odometer, Mileage & Hour Meter are assumed to be correct. However, these assumptions do not constitute a guarantee. It is up to the BUYER to validate the accuracy of the reading during the inspection process. Del Peterson & Associates is not liable for any inaccuracies pertaining to odometer, mileage and hour meter readings.

Auction Software
Del Peterson & Associates will not be held liable for any software or software malfunction discrepancies.

Equipment Removal
Removal and/or transportation of equipment shall be at the expense, liability and risk of the buyer. Items must be removed from the property 3 weeks after the conclusion of the auction.

Successful Bidders
Successful bidders must complete full payment to Del Peterson & Associates within 24 hours after receiving their invoice. No equipment will be released until payment is made in full. Del Peterson & Associates will notify sellers when we have received payment in full for release of equipment. Failure to comply with these terms will result in buyer "NOT TO PARTICIPATE" in future live or on-line auctions conducted by Del Peterson & Associates.

Invoicing
An invoice with payment instructions will be sent to each buyers registered email at the close of bidding. IF you do not receive an invoice via your email within 24 hours after the close of the auction, please contact us @ (800) 492-9090 immediately.

Late Fees/Returned Check Fees
Invoices not paid after 7 days following the conclusion of the auction are subject to a 3% finance charge. A fee of $50.00 will be assessed on returned checks and the bidder denied access to future auctions. Be sure you are capable of paying immediately after the conclusion of the auction and realize your bids are not conditional upon financing, unless the sale of an item is indicated otherwise.

Taxes
Please review your invoice carefully! In order to comply with the majority of state and local sales tax law requirements, it is necessary that we have in our files a properly executed exemption certificate from all of our customers who claim sales tax exemption. You may access these forms by clicking on DOWNLOAD SALES TAX EXEMPTION FORMS on the home page of our website. Please note we need you to fill out the sales tax form from the state in which the equipment was purchased, not from the state in which you are located. Del Peterson & Associates cannot offer opinions, advice or guarantees about whether or not you are in fact tax exempt. Please consult your tax advisors if you have eligibility questions. Guidelines and regulations regarding tax exemptions may vary between states.

Titles
Titles will be sent out by Priority Mail within 14 days after the conclusion of the auction, unless otherwise specified in the description of the item
